Mumbai: The High Court has issued strict orders to remove a mobile tower that was erected on the roof of a school building in South Mumbai. The court emphasized that the installation of such towers poses a potential risk to the safety of students and residents in the area. Additionally, it reinforced the existing guidelines that prohibit the construction of mobile towers on school, college, and hospital buildings.

Mobile Tower Installation Ban on Educational Buildings

According to the 2013 revised guidelines, the installation of mobile towers on the roofs of schools, colleges, and hospitals is strictly prohibited. However, in violation of these rules, a mobile tower was recently installed on the terrace of a school in the Dongri area, sparking concern among residents and parents.

Legal Action Taken by Local Residents

The Kaiser-E-Amin Building Tenants Association took the matter to the Bombay High Court, filing a petition against the mobile tower installation. The case was represented by Advocates Vishwanath Patil, Akshay Naidu, and Kedar Nhavkar. A division bench of Justice Ajay Gadkari and Justice Kamal Khata presided over the hearing. (Mumbai News)

High Court Orders Immediate Removal

During the hearing, the court reviewed the petition and referred to the January 21, 2013 guidelines, which mandate that landlords must obtain consent from the residents before installing mobile towers. More importantly, the guidelines strictly prohibit such installations on educational buildings, which was a key point of contention in the case.

The High Court took serious note of the safety concerns raised by the residents and immediately ordered the removal of the mobile tower from the school’s roof. The court further instructed that the necessary action should be taken with the help of the police if required, ensuring that the removal process is carried out without delay.

Impact of the Decision

This ruling by the Bombay High Court sets a significant precedent, reinforcing the prohibition of mobile tower installations on educational and healthcare buildings. It also brings to light the importance of following proper procedures and obtaining consent from all parties involved before such installations are made. (Mumbai Latest News)

The removal of the mobile tower will undoubtedly come as a relief to the residents and students who had raised concerns about the potential health hazards and safety risks. It also underscores the judiciary’s role in ensuring the well-being of citizens by enforcing regulatory guidelines
